VISTADEAL LIMITED WARRANTY

1. OBJECT

Vistadeal Sarl, 6 rue D'Arlon Windhof L 8399 ("VISTA"), guarantees that its products are free of material and manufacturing defects under the conditions provided for in the present policy. Any products recognised as defective by Vistadeal Sarl shall be repaired or replaced, based on the opinion of Vistadeal Sarl, at no cost, within thirty (30) days of the product being received. We remind you that the present policy does not exclude any possible rights guaranteed by national laws in terms of warranties for consumer goods and that you shall be free to exercise these rights.

2. EXCLUSIONS

The present warranty does not cover products that have come to the end of their normal useful life or damage resulting from accidents, modifications, negligence, abuse or inappropriate use, inappropriate or unreasonable maintenance, corrosion, incorrect assembly, repairs carried out in an inappropriate manner or replacement parts incorrectly added, the use of replacement parts or accessories that do not comply with the Vista specifications, the use of parts not produced or supplied by Vista, modifications that are not advised or approved in writing by Vista, normal wear and tear and deterioration due to product use, activities such as acrobatic cycling, commercial use of the product or use of the product in competition. The present warranty also does not cover aesthetic imperfections relating to the surface, the finish or the look of the product where said imperfections were evident or visible when the product was purchased, furthermore it does not cover damage due to the shipping or transport of the product. The present warranty also does not cover the tools, lubricants and other consumables, or any costs relating to the transport of the product to the Help Centre, or the labour costs required for dismanteling the component of the bicycle and does not give right to any compensation for inconvenience or non-use during the period the product is being repaired or replaced.

3. PURCHASER

The present warranty shall be for the first purchaser of the product only and it can not be extended to third parties. The rights of the purchaser by virtue of this policy shall not be transferable.

4. PERIOD OF VALIDITY

The period of validity of the present warranty shall be one year as from the retail purchase date, according to the product.

5. EXCLUSIVITY and PRIORITY.

The present warranty shall replace all previous warranties, declarations or promises made in writing or verbally and shall fully govern the relationship between the parties in terms of the product warranty. Any form of warranty or warranty provision not included in the present policy shall be expressly excluded.

6. DAMAGES.

With the exception of what has been expressly included in the present warranty, VISTADEAL CAN NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGE RESULTING FROM THE USE OF THE PRODUCT, OR ANY CLAIM OR DEMAND BY VIRTUE OF THE PRESENT POLICY, WHETHER THE CLAIM OR DEMAND BE OF CONTRACTUAL ORIGIN OR RESULT FROM AN ALLEGED ILLEGAL ACT OR OTHERWISE. The present warranty provisions shall be exclusive and shall replace all other recourse. The laws of certain countries prohibit the exclusion or the limitation of incidental or consequential damage, therefore the present limitation or exclusion might not be applicable in your case. In the event of any alleged warranty breaches, or in the case of legal proceedings instituted by the purchaser based on the alleged negligence of Vistadeal, the single only compensation for the Purchaser shall be the repair or replacement of the defective products as previously indicated.

7. WAIVER

ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A SPECIFIC PURPOSE AND ANY IMPLIED WARRANTY RESULTING FROM COMMERCIAL PRACTICE, LAWS OR OTHERWISE SHALL BE STRICTLY LIMITED TO THE TERMS OF THIS WARRANTY. As regards the purchase of the product, the purchaser can refer only to this warranty. No retailer or any other representative or employee of Vistadeal Sarl shall be authorised to amend, extend or widen the present warranty. Carrying out any warranty service by virtue of the present policy shall not constitute admission or acceptance that the design or the production of the product is defective.

8. PROCEDURE

In the case of a defect covered by the warranty, the purchaser must contact Vistadeal Sarl. In order to be considered, the claims must be filed during the 1 year warranty period (according to the product) and within eight (8) days of noticing the defect. Only Vistadeal Sarl shall have authority to determine whether or not a defect is covered by the present warranty. Vistadeal Sarl reserves itself the right to cease the production of articles and to modify the specifications of existing products at any time without any prior warning, and shall not be obliged to incorporate new features onto previously sold products, even if these products are returned for a claim under warranty. Vistadeal Sarl may replace defective parts with similar parts, of the same quality, if identical parts are unavailable. Before returning a product for checking, the purchaser must obtain written authorisation from Vistadeal Sarl. Vistadeal Sarl shall send the purchaser a return authorisation number which must be clearly shown on the outside of the product packaging. The issue of an authorisation number does not constitute the acceptance of a claim. This will be assessed by Vistadeal Sarl after having examined the product. The product must first be cleaned then packaged securely so as to avoid damage during transport. It must also be accompanied by a letter specifying or including the following:
a) sales receipt or other document proving the retail purchase date;
b) copy of the warranty;
c) reference for the part
d) detailed description of the problem noticed with the product, including a chronological description of what was done in order to find a solution to the problem;
e) identification of the parts used with the product;
f) estimation of the product use, i.e distance covered or time used;
g) your name, address and written authorisation to send the repaired product back to you "postage due".

9. APPLICABLE LEGISLATION AND COURTS HOLDING JURISDICTION.

Any disputes resulting from the present policy or from the use of this product shall be governed by the applicable law of Luxembourg. The court holding jurisdiction shall be the court of Luxembourg

10. WARNING.

We recommend that you carry out all installation, utilisation and maintenance procedures by closely following the instructions relating to the product. These instructions are also available on this Internet site from where you can download the relevant files.
